Terms of Use

These Terms govern the use of Dhamet.

By using the application, the user agrees to these Terms, the Privacy Policy, and the game rules published inside the application. If the user does not agree to these Terms, the user must not use the application.

1. Definitions

  • Application means Dhamet, the web application.
  • Company means El Ougl Software SARL.
  • User means any person who accesses or uses the application.
  • Account means the user’s account inside the application or through the authentication service used.
  • Content means texts, messages, names, images, icons, moves, gameplay data, or any data the user sends or creates inside the application.
  • Rules means the Dhamet game rules published inside the application.

2. Nature of the service

Dhamet provides a digital version of the Mauritanian game Dhamet through the browser. The application may include:

  • Play against the computer.
  • Online play.
  • Sending and receiving invitations.
  • Spectating some matches when available.
  • Player account and profile.
  • Statistics and ranking.
  • Text chat inside matches.
  • Voice conversation when enabled.
  • Local saving or resuming of some states.
  • Arabic, English, and French support.

Features may change, stop, be restricted, or be updated at any time according to operational, development, and security needs.

3. Account and sign-in

Some Dhamet features may require creating an account or signing in. The user must provide data that is accurate to the extent needed to operate the account and must protect their sign-in data.

The user must not:

  • Use another person’s account without permission.
  • Share an account in a way that causes misuse or harm to the application.
  • Impersonate a person or entity.
  • Use a misleading, offensive, or unlawful nickname.
  • Create multiple accounts to bypass restrictions, ranking, or security measures.

The company may restrict, suspend, or delete an account when these Terms are violated or the application is misused.

4. License granted to the user

The company grants the user a limited, personal, non-exclusive, non-transferable, revocable license to access the official published version of Dhamet and use it for personal, non-commercial purposes under these Terms.

This license does not grant any ownership right in the application, its code, design, assets, models, content, marks, or documentation.

5. Intellectual property

All rights in the application are reserved to the company, including:

  • Source code.
  • Design and interface.
  • Digital assets.
  • Texts and documentation.
  • Models or logic for play against the computer.
  • Technical architecture.
  • Marks, names, and logos connected with the application.
  • Any improvements, updates, or derivative works developed by the company.

Making the application available for free through the web does not mean it is open source and does not grant the user the right to copy, modify, republish, host, or operate another version of it.

6. Permitted use

The user may use the application for play, learning, practice, spectating, and communication within the available features, provided that the user complies with the rules, respects other users, and does not harm the service or try to bypass its restrictions.

7. Prohibited uses

The user must not, directly or indirectly:

  • Copy the application or extract its code, assets, or models.
  • Reverse engineer, decompile, or conduct unauthorized analysis of the application.
  • Modify the application, create a derivative version, or republish it.
  • Host another version of the application without written permission from the company.
  • Use the application commercially without permission.
  • Disrupt, slow, attack, or exploit vulnerabilities in the service.
  • Tamper with match synchronization, rooms, invitations, or ranking.
  • Use automated tools, bots, or scripts to play, collect data, or manipulate the service.
  • Cheat or exploit technical errors to gain an unfair result.
  • Impersonate another user.
  • Send spam, abusive, threatening, or fraudulent messages.
  • Use chat or voice for harassment, abuse, or publishing private information about others.
  • Publish illegal or harmful content or content that infringes the rights of others.
  • Attempt to access data, accounts, or rooms the user is not authorized to access.
  • Bypass protection measures or technical restrictions.
  • Use the application in a way that violates the law or these Terms.

8. Game rules

Matches are subject to the Dhamet rules published inside the application. The user should read and understand the rules before objecting to a result, move, or penalty inside the game.

The game includes specific rules such as the mandatory opening, capture, Souvla, piece movement, and win or draw conditions. The application may apply these rules automatically or provide tools to apply some of them during a match.

If there is a difference between a user’s understanding of the game and the rules published inside the application, the rules published inside the application are the operational reference for the digital version until they are updated or corrected.

9. Online play

Online play depends on the user’s connection, browser, synchronization services, and the other party’s state. Delays, disconnections, temporary state differences, or invitation or room failures may occur.

The company does not guarantee that every online match will be completed without interruption or error. The application may end a room, delete operational data, or reset a state when technically or securely necessary.

10. Text chat

In-match chat is intended for communication related to play. The user is responsible for the messages they send.

Chat must not be used for:

  • Insults, abuse, or threats.
  • Harassment or personal targeting.
  • Publishing private data about others.
  • Sending misleading or harmful links.
  • Fraud or asking for passwords or sensitive data.
  • Publishing illegal, immoral, or rights-infringing content.
  • Flooding the room with repeated or annoying messages.

The company may delete content, restrict an account, or disable a feature when chat is misused.

11. Voice conversation

Voice conversation is an optional feature in some play modes. It requires microphone permission from the browser. The user can mute the microphone or disable the permission from browser settings.

Voice must not be used for:

  • Abuse, threats, or harassment.
  • Recording or publishing other people’s voices without permission when this violates the law.
  • Sharing sensitive data or passwords.
  • Disrupting, annoying, or interfering with the play experience.

The company does not guarantee the quality or continuity of the voice connection because it depends on the browser, device, network, and supporting technical services.

12. User-provided content

The user retains the rights they own in the content they provide, but grants the company a limited license to use that content to the extent needed to operate, display, transmit, store, synchronize, process, delete, or protect the application.

This may include nicknames, messages, gameplay data, moves, statistics, and room data.

The user must not send content they do not have the right to use or content that violates the rights of others.

13. Statistics and leaderboard

The application may display player statistics and ranking. This data is operational and is not an official or guaranteed record.

Statistics and ranking may be affected by technical errors, connection loss, system updates, account deletion, maintenance, or misuse attempts. The company may correct, recalculate, delete, or ignore ranking data when needed.

The user does not acquire a vested right in a specific ranking, point, or statistic.

14. Improving play against the computer

The company may use technical data from some matches or states to improve play against the computer, develop performance, test logic, or train supporting models.

The user must not attempt to extract gameplay models, analyze them, reuse them, or turn them into a separate product without written permission.

15. Contact and support

The user may contact the company through the official contact page or email. The company is not required to respond to every message, but may use messages to improve the service or handle reports or support.

Contact messages should not contain unnecessary sensitive data, such as passwords, financial data, or private information about others.

16. Suspension and termination

The company may, without prior notice when necessary, take any of the following actions:

  • Restrict access to a feature.
  • Suspend the account.
  • Delete the account or some associated data.
  • Disable chat or voice.
  • Remove violating content.
  • Block use of the application temporarily or permanently.
  • Take technical measures to protect the service.

These actions may be taken when the Terms are violated, the application is misused, cheating is attempted, security is threatened, others’ rights are violated, or the user experience is harmed.

17. Updates and changes

The company may update the application, change its features, modify the interface, operational rules, Terms, or Privacy Policy. Updates may change gameplay, saving, synchronization, ranking, or accounts.

Continued use of the application after an update is published means acceptance of the updated Terms.

18. Availability and interruption

The application is provided according to available technical capacity. The company does not guarantee that the application will always be available, free of errors, or suitable for every device, browser, or connection.

The application may stop fully or partially because of maintenance, updates, network errors, external services, browser restrictions, or circumstances outside the company’s control.

19. External services

The application relies on external services such as authentication, databases, analytics, hosting, email, or voice communication services. These services are subject to their own terms and policies.

The company is not responsible for interruption, change, or error caused by an external service except to the extent required by law.

20. Disclaimer

The application is provided as is and as available. The company gives no express or implied warranties regarding freedom from errors, continuity, fitness for a particular purpose, or accuracy of every result, ranking, or statistic.

To the extent permitted by law, the company is not liable for any direct, indirect, incidental, or consequential damages resulting from use of the application, inability to use it, loss of data, connection interruption, synchronization errors, or actions of other users.

21. Limitation of liability

If the company is found liable in a specific case, its liability is limited to the extent permitted by law and in a manner consistent with the free nature of the service, without affecting any rights that cannot legally be excluded.

22. Minors

If the user is a minor under the law applicable to them, the application must be used with the approval or supervision of a parent or guardian. The parent or guardian is responsible for monitoring the minor’s use of the application and its chat or voice features.

23. Governing law and jurisdiction

These Terms are governed by the laws applicable to the company and its place of registration, unless mandatory legal rules provide otherwise. In case of dispute, the parties should first seek an amicable solution through official contact channels before any other action.

24. Severability

If any provision of these Terms is considered invalid or unenforceable, the remaining provisions remain effective to the extent possible.
